EPA Region 10 Stormwater Requirements

The 2012 CGP replaces the 2008 CGP (which expired on February 15, 2012), and will provide coverage for eligible new and existing construction projects for a period of five years.

The 2012 CGP includes a number of modifications to the 2008 CGP, many of which are necessary to implement the new Effluent Limitations Guidelines and New Source Performance Standards for Construction and Development point sources, known as the “C&D rule.”

The EPA issued a numeric limit for turbidity in the 2009 final effluent guideline rule for the Construction and Development Point Source Category which established national monitoring requirements and enforceable numeric limitations on stormwater discharges from construction sites. Subsequently the EPA withdrew the limit to correct a calculation error that was identified in petitions filed by the Small Business Administration and the National Association of Home Builders. The EPA submitted a proposed rule to revise the turbidity limit to the Office of Management and Budget (OMB) in December 2010. The EPA has recently withdrawn this proposal from OMB. In order to ensure that we adequately characterize the best performance achievable by the technology, EPA has decided to seek additional treatment performance data from construction and development sites before proposing a revised numeric turbidity limit. We plan to publish a Federal Register notice soliciting data in the near future.

Once review of a proposed rule revising the numeric turbidity limit is completed by OMB, the EPA will publish the proposed rule for public comment.

Washington

WAR12000F Areas in the State of Washington, except those located on Indian country, subject to construction activity by a Federal Operator

Basic Requirement:  EPA Permit & oversight on the project, follow Washington State DOE requirements for inspection and Stormwater Pollution Prevention Planning (SWPPP). No DOE stormwater monitoring or reporting is required, but is strongly recommended.  On military bases, the Army Corp of Engineers may already have a permit.

Oregon

Synopsys: If you are doing a federal project or a project on federal land, military base or Indian reservation you need to apply directly to the  EPA's 2012 General Construction Permit (CGP)  .  Application can be made using EPA e-noi (electronic notice of intent stormwater application)  Section 9.3  outlines the overlay of the oversight between EPA & Oregon Department of Enviornmental Quality (DEQ) on Indian lands.

Basic Requirement:  EPA Permit & oversight on the project, follow Oregon DEQ requirements for inspection and Stormwater Pollution Prevention Planning (SWPPP). On military bases, the Army Corp of Engineers may already have a permit.

Alaska

Synopsys: If you are doing a project clearing more than one (1) acre you must apply directly to the  EPA's 2012 General Construction Permit (CGP)   Application can be made using EPA e-noi (electronic notice of intent stormwater application) Section 9.1  outline the overlay of the oversight between EPA & Alaska Department of Environmental Conservation (DEC) and the City of Anchorage

Basic Requirement:  EPA has permit & oversight on the project, DEC & City of Anchorage have additional requirements for inspection and Stormwater Pollution Prevention Planning (SWPPP).

Idaho

Synopsys: If you are doing a project clearing more than one (1) acre you must apply directly to the  EPA's 2012 General Construction Permit (CGP) .  Application can be made using EPA e-noi (electronic notice of intent stormwater application)  Section 9.2  outline the overlay of the oversight between EPA & Idaho Department of Environmental Quality

Basic Requirement:  EPA has permit & oversight on the project, DEC may have additional requirements for inspection and Stormwater Pollution Prevention Planning (SWPPP).
